Welcome to PorchBerry. By accessing or using porchberry.com, PorchBerry’s platform, applications, services, or website, you agree to comply with and be bound by these Terms of Service & Conditions. If you do not agree with any part of these Terms, please do not use the platform.

Marketplace Platform

PorchBerry is a technology marketplace platform that facilitates connections between individuals, families, organizations, communities, and independent Support Pros providing non-medical support services. PorchBerry is not a home healthcare agency, staffing agency, transportation company, medical provider, or employer of Support Pros.

Independent Contractor Relationship

Support Pros are independent contractors and are not employees, agents, partners, joint venturers, or representatives of PorchBerry. Support Pros are solely responsible for their conduct, taxes, insurance, transportation, scheduling availability, compliance with laws, and services provided.

Use of the PorchBerry platform does not create an employment relationship between PorchBerry and users, between PorchBerry and Support Pros, or between users and PorchBerry. PorchBerry solely facilitates marketplace connections.

Non-Medical Services Only

PorchBerry facilitates access to non-medical services only. PorchBerry does not provide medical care, nursing services, medication administration, clinical supervision, healthcare advice, emergency services, or medical transportation. Medical emergencies should immediately be directed to 911.

Prohibited Services

The following services are prohibited unless expressly authorized in writing:

Medication administration, wound care, medical lifting, nursing services, emergency medical services, financial management, legal services, firearm handling, controlled substance handling, and medical transportation.

User Responsibilities

Users agree to provide accurate information, comply with applicable laws, maintain respectful conduct, protect account credentials, and use PorchBerry lawfully. Users may not misuse the platform or engage in fraudulent, abusive, threatening, discriminatory, or illegal conduct.

Bookings, Payments & Refunds

PorchBerry may facilitate payments through third-party payment processors. Users agree to applicable platform fees, cancellation policies, no-show fees, refund procedures, late cancellation fees, and chargeback review procedures. PorchBerry reserves discretion regarding disputes and refund determinations.

Background Checks

PorchBerry may facilitate background screenings, identity verification, fingerprinting, and driving record checks through third-party providers. Background checks are limited snapshots in time and PorchBerry does not guarantee the safety, reliability, conduct, identity, or future behavior of any user or Support Pro.

Transportation Services

Transportation services may involve independent Support Pros operating personal vehicles. PorchBerry does not own, inspect, supervise, manage, or control vehicles used by Support Pros. Users acknowledge that transportation involves inherent risks.

Assumption of Risk

Users voluntarily assume all risks associated with use of the PorchBerry platform and services facilitated through independent Support Pros, including but not limited to transportation risks, falls, injuries, property damage, in-home incidents, third-party interactions, mobility-related incidents, and emotional distress.

Release of Liability

To the maximum extent permitted by law, users release and hold harmless PorchBerry, its owners, affiliates, officers, employees, contractors, and partners from claims arising from user conduct, independent contractor conduct, transportation incidents, injuries, property damage, disputes, criminal acts, service dissatisfaction, third-party conduct, or platform use.

No Warranty

PorchBerry provides the platform on an “as is” and “as available” basis without warranties of any kind. PorchBerry does not guarantee service quality, compatibility, availability, uninterrupted operation, booking fulfillment, or specific outcomes.

Platform Availability

PorchBerry may experience interruptions, maintenance, delays, outages, technical errors, or scheduling issues. PorchBerry does not guarantee continuous platform availability.

Safety Reporting & Emergencies

Users and Support Pros must immediately report serious incidents involving injuries, falls, threats, harassment, abuse allegations, unsafe conduct, property damage, missing property, or criminal activity. Emergencies should immediately be reported to 911.

Elder Abuse & Safety Concerns

PorchBerry takes allegations of abuse, neglect, exploitation, or unsafe conduct seriously and may suspend or terminate accounts pending investigation of reported concerns.

Insurance Requirements

Support Pros providing transportation services must maintain valid driver’s licenses and legally required automobile insurance. PorchBerry may request proof of insurance or related documentation at any time.

User Content & Website Usage

Users may submit reviews, messages, photos, profile information, comments, and other content through PorchBerry. Users grant PorchBerry a limited non-exclusive license to display, reproduce, edit, and use submitted content for platform operations and business purposes.

Users may not copy, republish, reproduce, duplicate, redistribute, sell, rent, or sublicense material from porchberry.com without written permission.

Comments or user-submitted content do not reflect the views or opinions of PorchBerry. PorchBerry reserves the right to monitor, review, or remove content considered inappropriate, offensive, unlawful, or in violation of these Terms.

Cookies

PorchBerry may use cookies and tracking technologies to improve website functionality, analytics, marketing, and user experience. By using the website, users consent to the use of required cookies.

Hyperlinks & Third-Party Links

PorchBerry’s website may contain links to third-party websites or services. PorchBerry is not responsible for the content, privacy practices, or operations of third-party websites.

Organizations may link to PorchBerry’s website provided the link is not misleading, deceptive, or falsely implies sponsorship or endorsement.

Intellectual Property

Unless otherwise stated, PorchBerry and its licensors own the intellectual property rights for all content, branding, graphics, logos, and materials on porchberry.com. All rights are reserved.

Arbitration Agreement & Class Action Waiver

Disputes arising from or relating to PorchBerry, its platform, bookings, users, or Support Pros shall be resolved through binding arbitration rather than court proceedings except where prohibited by law. Users waive the right to participate in class actions, class arbitrations, or representative claims. Arbitration shall occur in the State of Georgia unless otherwise required by law.

Electronic Consent

Users consent to receive electronic communications, agreements, disclosures, notices, and records electronically. Electronic signatures, acknowledgments, and checkbox confirmations may be treated as legally binding.

Force Majeure

PorchBerry shall not be liable for delays or failures resulting from causes beyond its reasonable control including natural disasters, weather events, internet outages, pandemics, labor disruptions, governmental actions, or emergencies.

Account Suspension & Termination

PorchBerry reserves the right to suspend, restrict, or terminate accounts for violations of these Terms, unsafe conduct, fraudulent activity, misuse of the platform, or behavior negatively impacting PorchBerry or its users.

Minimum Age Requirement

Users must be at least 18 years old to create accounts or use PorchBerry services unless otherwise permitted by applicable law.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between users and PorchBerry regarding use of the platform and supersede prior agreements or understandings.

State-Specific Compliance

Users acknowledge that marketplace platform, transportation, independent contractor, and home service laws vary by state. Users and Support Pros are responsible for complying with applicable laws and regulations.

Modifications to Terms

PorchBerry reserves the right to modify these Terms at any time. Continued use of the platform constitutes acceptance of updated Terms.
